/ respecter! asadho republique démocratique du congo « asadho demande au gouvernement congolais d’appuyer les activités socio-économiques des femmes rurales » en marge de la date du 15 octobre, journée internationale consacrée aux femmes rurales par l’assemblée générale des nations unies depuis 2008, l’association africaine de défense des droits de l’homme, asadho en sigle, saisie cette occasion pour rappeler au gouvernement congolais les engagements qu’il avait pris au mois de mars 2012 pour faciliter et améliorer le travail des femmes rurales. malgré le rôle majeur qu’elles jouent pour assurer la sécurité alimentaire et l’approvisionnement des grands centres urbain en produits agricoles, elles rencontrent beaucoup de difficultés pour accéder aux services essentiels tels que le crédit bancaire, les intrants, les outils de travail, l’eau, la formation et l’éducation. en plus, il importe d’indiquer que leur contribution au sein de la société est largement méconnue quand bien même elles s’occupent non seulement des tâches agricoles mais également de celles propres à leurs foyers et à la communauté. en effet, la plupart de ces femmes font face à de véritables obstacles pour subvenir aux besoins de leur famille et pour leur épanouissement intégral. c’est pourquoi, il est important à cette occasion de rappeler au gouvernement de la r.d.congo son engagement « d’investir dans la femme rurale et la jeune fille pour un avenir meilleur ». dans cette optique, le gouvernement congolais devrait mettre en place des mécanismes qui permettent aux femmes rurales d’accéder au crédit bancaire à des conditions favorables et de leur fournir des outils et des intrants nécessaires à l’amélioration de leurs conditions de travail. face à cette situation, l’asadho recommande : § au gouvernement : - de poursuivre son projet tendant à réhabiliter et d’entretenir les routes de desserte agricole pour faciliter aux femmes rurales l’écoulement de leurs produits agricoles. § au ministère du genre, de la famille et de l’enfant : - de mettre en place un programme d’encadrement des femmes rurales en vue de renforcer leur capacité de production ; - de mettre à la disposition des femmes rurales des facilités tendant à l’amélioration de leurs activités (outils, accès au crédit bancaire, accès à des lopins des terres…) § au parlement : - de voter une loi qui facilite l’accès de la femme à la propriété foncière et aux micros crédits ; § a la communauté internationale : - de soutenir matériellement et financièrement les ong nationales œuvrant dans les actions tendant à promouvoir et à protéger ces femmes rurales ; 13 comments no trackback ditshwanelo – the botswana centre for human rights: press statement on the landmark customary inheritance law decision by fidh on wednesday 17 october 2012, 12:20 - respect! / respecter! botswana discriminations ditshwanelo héritage inheritance 12 october 2012, gaborone – the botswana centre for human rights notes with appreciation, today’s high court decision in the case of mmusi and others v ramantele and another. judge key dingake ruled that the ngwaketse customary law inheritance rule, which hitherto has provided for male-only inheritance of the family home, is discriminatory. attorney tshiamo rantao, representing mmusi and her sisters, had argued that this provision is discriminatory on a number of grounds. these included section 3 of the constitution of botswana which provides for the right to equality and reference to relevant regional and international law. in contrast, attorney thabiso tafila representing the nephew, ramantele, had argued that this customary law did not discriminate against women, but merely differentiated between men and women. the court asked the attorney-general for an opinion to assist it in its decision-making. the attorney-general argued that botswana society was not ready for equality even though the customary rule is discriminatory. the attorney-general argued that the rule should remain. this ruling is particularly timely as botswana will be appearing before the human rights council in february 2013 for its second cycle of the universal periodic review (upr). in the first upr review in 2008, the human rights council (through canada) had recommended that ‘botswana increase efforts to raise awareness of the precedence of constitutional law over customary laws and practices to promote gender equality’. botswana’s response was that ‘botswana does not accept the recommendation. customary law is not in conflict with constitutional law’. the human rights council (through mexico) had recommended that botswana ‘adopt measures necessary for harmonising customary laws with international instruments’. botswana had replied that it ‘does not consider its customary law to be in conflict with international instruments, and therefore does not accept the recommendation’. today’s ruling clearly indicates that the customary law inheritance rule which allows for male-only inheritance of the family home by the youngest-born son, is not in conformity with either the constitution of botswana or international instruments to which botswana has committed herself. 36 comments no trackback thursday 8 march 2012 guinée : nos organisations attendent des engagements forts des autorités sur la protection des droits des femmes by fidh on thursday 8 march 2012, 16:59 - ratify!
